The petitioner is languishing in custody since 28.04.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 307, 302 of the Indian Penal Code and 27 of the Arms Act.
It is alleged that while the informant and his brother were travelling in a boat when this petitioner, Mahesh Yadav, Maheshwari Paswan and three unknown made indiscriminate firing. After jumping from the boat when the brother of the informant was swimming to escape this petitioner fired at him, who succumbed to the injuries.
Considering the specific accusation of firing against this petitioner, this Court is not inclined to grant bail to the
Patna High Court Cr.Misc. No.31801 of 2014 (05) dt.02-02-2015 2/2 petitioner in connection with Surajgarha P.S. Case No. 142 of 2013 pending in the court of learned Chief Judicial Magistrate, Lakhisarai.
Accordingly, the prayer for bail of the petitioner is rejected.
