The petitioners seek bail in a case registered for the offences punishable under section 302 and other allied sections of the Indian Penal Code.
The petitioners along with other accused persons are alleged to have come at the darwaza of the informant. Coaccused Nand Singh assaulted the mother of the informant and opened fire which hit Anita Kumari. Petitioner no. 1 Dhanjee Singh is alleged to have fired on Premchand Singh but the firing did not hit Premchand Singh. There is no allegation of assault against the petitioners. Anita Singh, daughter of the informant succumbed to the injuries. Nand Singh is the assailant of the
Patna High Court Cr.Misc. No.30312 of 2015 (2) dt.12-08-2015 deceased. Similarly situated co-accused Daya Nand Singh has already been enlarged on bail by order dated 17.06.2015 vide Criminal Misc. No. 20686 of 2015.
Considering the facts aforesaid, let the petitioners above named be directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Basant Kumar, Judicial Magistrate, 1st Class, Bikramganj (Rohtas) in connection with Nasriganj (Rajpur) P.S.
