ANJANA MISHRA ORAL ORDER 01-06-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 20.04.2014 in connection with a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that an unknown dead-body was recovered from the compartment of Amarnath Express and after some investigation, three persons were taken into custody which included the petitioner. It is further submitted that since the other two co-accused who had also been taken into custody were considered to be juvenile, have been granted regular bail, whereas the petitioner is languishing in jail for no fault of his own. It is further submitted that there are no witness who are coming forth in the trial to support the prosecution case.

No.23364 of 2016 (2) dt.01-06-2016 P2/2 Considering the fact that the petitioner has been taken into custody only on the basis of suspicion and that he has no criminal antecedent and has been rotting in jail since two years, let the petitioner abovenamed be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Bhagalpur in connection with G.R.P. (Rail Bhagalpur) P.S. Case No. 16/2014.
