JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and one co-accused Kanhaiya Kumar were caught with one stolen motorcycle and one master key. Submission on behalf of the petitioner is that the seized motorcycle belongs to co-accused Kanhaiya Kumar and, as a matter of fact, the petitioner requested the co-accused Kanhaiya Kumar to teach him driving and, after that, when the petitioner alongwith co-accused Kanhaiya Kumar was learning the driving, police came there and arrested the petitioner and others and, after that, got implicated the petitioner in the present case as well as three other cases. Prior to institution of the present case, the

Patna High Court Cr.Misc. No.21063 of 2016 (2) dt.20-05-2016 2/2 petitioner had not been made accused in any other case. Petitioner is in jail custody since19.12.2013 and the investigation against the petitioner has already been completed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIII, East Champaran at Motihari in connection with Chakia P.S.Case No. 268 of 2015.
