JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-12-2019 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. The issue raised in the present writ petition is arbitrary fixation of compensation.
Learned counsel appearing on behalf of the petitioners submits that the neighours of the petitioners have been paid more compensation amount, whereas the petitioners have been paid less compensation amount than what they deserve. This kind of grievance cannot be agitated in the present proceeding. If the respondents have abused their discretion in the matter of award of compensation, it would be open for the petitioners to agitate the same before the District
Patna High Court CWJC No.243 of 2019(2) dt.04-12-2019 3/3 Magistrate, who shall be under obligation to cause an enquiry and take corrective measures, if there is any irregularity found in the matter of payment of compensation to any person. Necessary corrective measures in this regard must be taken by the respondents after hearing all stakeholders at the earliest preferably within six months from the date of receipt/production of a copy of this order.
With the aforesaid, all the three writ petition stand disposed of.
