JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/353/504/506/120B and other ancillary sections of the Indian Penal Code and section 67 of the IT Act.

Prosecution case is that all the FIR named accused persons including this petitioner and 150 unknown persons assembled and obstructed road from all the sides and started protest against the police party. They pelted stones causing injuries to the police men and also forwarded posts on social media against the administration.

Learned counsel for the petitioner submits that the allegation against this petitioner is general and omnibus in nature and no overt act has been alleged against him. Petitioner has got no criminal antecedent.

In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in Khagaria Police Station Case No. 1042 of 2022/GR No.2802 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
