Mr. Dhurjati Kumar Prasad, GP-14 ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJIV ROY ORAL ORDER 17-06-2025 No one appears on behalf of the petitioner though Mr. Dhurjati Kumar Prasad, learned GP-14 is present.
2. The present petition has been preferred for the grant of following relief:
"for the issuance of a writ of mandamus seeking direction to respondent authorities to conclude
2/4 the proceeding of Land Acquisition Case No. 01/2014-15 initiated on 03.03.2014 and consequent whereupon, to make payment of compensation amount to the petitioner as Block level offices had been constructed over his 4.40 acres of commercial lands at Nawanagar block in Buxar district way back in the year 1980 without initiation of any land acquisition proceedings and also for payment of statutory interest as well as penal interest along with the costs for non-payment of compensation amount within stipulated time and for any other writ/writs, order/orders which the petitioner may found to be entitled in the facts and circumstances of the case."
3. A counter affidavit on behalf of the respondent no.3 is on record duly signed by the Joint Secretary, Rural Development Department, Bihar, Patna. Learned State counsel has taken this Court to paragraph nos. 20 and 21 which read as follows:
20. That from the order sheet of the District Land Acquisition Officer, Sahabad that land
3/4 acquisition process has been made for acquiring the land in question and award has been prepared on 26.04.1971 and the payment has been made to then land owner namely South Bihar Sugar Mill Ltd. Bihta. From the order sheet it is also evident that theland in question has been taken in possession by the concerned authority of the Government of Bihar for construction of Block-cum-Circle Office, Nawanagar. The order sheet has already been annexed as Annexure-C/9 sereies in the present counter affidavit.
21. That it is is stated that writ petitioner has also admitted in the writ petition that land in question was earlier belong to South Bihar Sugar Mill Ltd. Bihta and he has stated in writ application that he has purchased the said land from the South Bihar Sugar Mill Ltd. Bihta. The writ petitioner has not enclosed any supportive document like sale deed which shows that the said land in question has been purchased by him from the South Bihar Sugar Mill Ltd. Bihta.

4. The counter affidavit was filed in the month of June, 2024 and there is no rebuttal to the said statement. Though the counter affidavit stands unrebutted, in view of the fact that no one has appeared on behalf of the petitioner, the writ petition stands dismissed for non-prosecution.
