JUSTICE ASHUTOSH KUMAR ORAL ORDER 28-05-2020 Heard Mr. Ajay Kumar Thakur, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in connection with Barauni (F.C.I.O.P.) P.S. Case No. 431 of 2019 dated 23.09.2019 registered for the offence under sections 25(1-b)a, 26, 35 of the Arms Act and Section 3/4 of Explosive Substance Act. He is stated to be in custody since 24.09.2019. In one other case, in which he was earlier made an accused, he is on bail.

According to the First Information Report, on secret information that some miscreants have assembled at a place for planning to commit some offence, a raid was conducted. The petitioner and one Md. Arshad are said to have been arrested with a cache of arms and other incriminating objects. However,

Patna High Court CR. MISC. No.4929 of 2020(3) dt.28-05-2020 2/2 nothing appears to have been recovered from the personal possession of either the petitioner or Md. Arshad. Considering this aspect of the matter, co-accused Md. Arshad has been granted bail by a Bench of this Court in on 03.03.2020 in Criminal Miscellaneous No 14706/2020.

Regarding being had to the fact that there has not been any recovery from the personal possession of the petitioner and his period of custody, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni (F.C.I.O.P.) P.S. Case No. 431 of 2019.
