====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 31-01-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Nautan (Jagdishpur) P.S. Case No. 238 of 2019 for the offenses under Sections 399, 402, 414 of the Indian Penal Code and 25(1-b)a, 26 and 35 of Arms Act.

Learned counsel for the petitioner submits that the alleged arm recoveries were made from co-accused but not from the petitioner. In the instant case only a cell phone was seized from the possession of the petitioner. The petitioner is in custody since 26.09.2019.

Considering the fact that no arms were recovered from the possession of the petitioner, the Court is inclined to

Patna High Court CR. MISC. No.5199 of 2020(2) dt.31-01-2020 2/2 grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Nautan (Jagdishpur) P.S. Case No. 238 of 2019.
