In this case, the petitioner is seeking bail in connection with Mokama P.S. Case No. 121 of 2014 registered for offences under section 392 of the Indian Penal Code. An allegation has been made by the Informant that while he was returning after doing the business, three miscreants, causing fear of death on the strength of pistol, looted mobile phone and Rs. 1300/-. The name of the petitioner has come in course of investigation on the confessional statement of Mantosh Kumar. The petitioner has got criminal antecedent. The petitioner is in jail custody since 24.12.2014.

Looking to the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.21401 of 2016 (2) dt.19-05-2016 the petitioner, namely, Alok Kumar Singh @ Moni, be released on bail in the 3rd week of June, 2016 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Barh, Patna in connection with Mokama P.S. Case No. 121 of 2014, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
