JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2015 The petitioner is languishing in custody since 30.05.2015 in connection with Triveniganj P.S. Case No. 51 of 2015 for the offences instituted under Sections 307, 379, 147, 148, 448, 504, 323, 324 and 427 of the I.P.C.
Heard learned counsel for the petitioner and learned counsel for the State.
It is alleged that the accused persons assaulted the informant, his family members, stolen away jewellery worth Rs. 75,000/-, drum with corn and also damaged the motorcycle and other articles.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent and he is in custody since 30.05.2015. It is further submitted that there is general and
Patna High Court Cr.Misc. No.29319 of 2015 (2) dt.05-08-2015 2/2 omnibus allegation has been made against the petitioner. No specific injury has been attributed. It is a case and counter case. It is further submitted that the petitioner's side has also sustained injury but it has not been explained by the prosecution case. It is further submitted that the petitioner may be released after six months in custody from 30.05.2015.
On behalf of the State and the informant it has been submitted that the petitioner is also one of the persons who had taken part in assault. The victims have sustained grievous injury. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail after completion of six months in custody from 30.05.2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Supaul, in connection with Triveniganj P.S.
