The petitioner seeks bail in connection with Sheikhpura Mahila P.S. Case No. 09 of 2016 registered for the offences punishable under Sections 448, 452, 354, 376, 379, 504, 509 of the Indian Penal Code, Sections 3(i) (x) (xi) (xii) of SC/ST (Prevention of Atrocities) Act and Section 4 of POCSO Act. Allegedly, the petitioner committed rape with the informant aged 16 years and thereafter gave assurance to marry with her and continued developing physical relationship with her, resulting, the informant became pregnant and the petitioner refused to marry with her.
Submission is of false implication and that the petitioner is ready to marry with her, the informant is also ready to marry with the petitioner and in this regard both have filed petition and
Patna High Court Cr.Misc. No.21032 of 2016 (3) dt.30-06-2016 affidavit vide annexure-2 and 3 and as such the petitioner deserves sympathetic consideration to which learned APP opposes. In the facts and circumstances stated above, considering the allegations attributed against the petitioner, this Court is not inclined to enlarge the petitioner on bail, accordingly, his such prayer stands rejected.
