JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Nautan P.S. Case No.185 of 2019 registered for the offences punishable under Sections 25(1-b) a, 26 and 35 of the Arms Act. One person namely, Raju Mahato was arrested and in his possession one loaded country made Katta was recovered The aforesaid apprehended co-accused disclosed the name of petitioner.

Submission on behalf of the petitioner is that no case under penal section of Arms Act is made out against the petitioner and except the so-called confessional statement of coaccused, there is nothing against the petitioner but I am not at all convinced with the aforesaid submission and, accordingly,

Patna High Court CR. MISC. No.5073 of 2020(2) dt.03-03-2020 2/2 his prayer for anticipatory bail in connection with Nautan P.S.Case No. 185 of 2019, pending in the court of Chief Judicial Magistrate, Bettiah, West Champaran stands rejected. However, it is made clear that if the petitioner surrenders and seeks regular bail within six weeks from today, the concerned court shall consider the regular bail application of the petitioner on its own merit without being prejudiced by this rejection order.
