The petitioners are in custody in connection with Khagaria (Gangaur) P.S.Case No.498 of 2011 registered for an offence under Sections 302, 201 and 120B of the IPC. As per the prosecution case, it is a case of murder of one Manik Paswan by the accused persons.

Learned counsel for the petitioners submits that the petitioners are in custody since 02.03.2016. Petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses against the petitioners. Petitioners are not named in the FIR. Petitioners have falsely been implicated in the present case.

Patna High Court Cr.Misc. No.22386 of 2016 (3) dt.03-08-2016 In course of investigation, it has come that the petitioners were seen along with the deceased on the alleged date of occurrence. It is a case of last seen. The other co-accused has been granted bail by this Court vide Cr.Misc.No.49122 of 2015.

On behalf of the State, it is submitted that the petitioners' name have come in course of investigation. Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of CJM, Khagaria in connection with Khagaria (Gangaur) P.S.Case No.498 of 2011.
