JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-02-2020 Petitioner seeks regular bail in connection with Majhauliya P.S. Case No. 457 of 2019 registered for the offence punishable under Sections 341, 323, 324, 307, 354/B/34, of the Indian Penal Code and Section 8 of POCSO Act. As per prosecution case petitioner and one other accused person surrounded the informant and tried to outrage the modesty and assaulted by dab on the head of the informant's mother.

Submission of the learned counsel for the petitioner is that there is no allegation of outraging the modesty or of assault against this petitioner. He is in custody for about four months. He is ready to abide all terms and conditions which is imposed upon him.

Heard learned A.P.P. who has opposed the prayer for

Patna High Court CR. MISC. No.7544 of 2020(2) dt.18-02-2020 2/2 bail on the ground that the impugned order disclosed that the petitioner and other accused persons are threatening the informant and his family members.

Having heard both sides, no doubt impugned order disclosed that petitioner has threatened the informant but no specific materials have been mentioned in the order, as such, let the petitioner above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-1st-cum-Special Judge, Bettiah, West Champaran, in connection with Majhauliya P.S. Case No. 457 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
