Learned counsel for the petitioner is directed to remove the defects.

The petitioner apprehends his arrest in connection with Complaint Case No.C-1991 of 2017, registered for the offence punishable u/s 498A of the IPC and 3⁄4 of D.P. Act. The prosecution case in short is that the complainant was tortured and assaulted by the FIR named accused persons including the petitioner (husband) for non-fulfillment of demand of dowry. She was ousted out of her matrimonial house. Vide order dated 28.07.2022, the case was heard and thereafter the matter was sent to the Mediation Center.

I perused the report of the Mediator dated 15.09.2022, in which he stated that the learned Advocate for the Opposite Party No. 2 has appeared but neither the Opposite Party No. 2 nor the petitioner appeared. Hence, due to non cooperation of the parties the mediation failed.

Considering these facts and circumstances, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. This application is accordingly dismissed.
