Petitioner apprehends arrest in a case registered for the offence punishable under Sections 120(B), 420, 467, 468 and 471 of Indian Penal Code.

As per prosecution case, petitioner fraudulently obtained loan on the basis of forged documents and used it for personal purpose.

Learned counsel appearing for the petitioner submits that the petitioner has already deposited Rs. 25,43,046.81/-. On the basis of bank statement it is submitted that petitioner has further deposited Rs. 99,995.26/- and only Rs. 7,41,942/- remains to be paid which he intends to pay in 6 installments

Patna High Court CR. MISC. No.5843 of 2022(5) dt.09-11-2022 2/2 with a period of 1 year.

Aforesaid statement made on behalf of the petitioner is not disputed by counsel for the C.B.I. in his counter-affidavit. Considering the submission of the petitioner, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 1,00,000/- (one lac) with two sureties of the like amount each and deposit rest of the due i.e., Rs. 7,41,942/- in six installments within a period of 1 year from the date of release of the petitioner to the satisfaction of Spl. Judge CBI-I, Patna in Special Case No. 02 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. Failing which the Court below is at liberty to cancel the bail bond of the petitioner.
