2. The petitioner seeks regular bail in connection with Katihar Rail P.S. Case No. 12 of 2023 lodged under Sections 8(c)/21(c)/29 of the N.D.P.S. Act.

3. As per the prosecution case, the F.I.R. has been lodged against the petitioner and total recovery of 423 gram of heroine has alleged to be made from the possession of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the petitioner is a female aged about 27 years and her entire career shall be spoiled.

5. Counsel for the petitioner submits that the

6. Learned counsel for the State opposes the prayer for bail and submits that on the previous occasion, case diary as well as FSL have been received. Upon perusal of the FSL report, it transpires that the seized material was 423 gram heroine which was recovered from the possession of the petitioner and the said quantity is more than the commercial quantity.

7. In the present facts and circumstances of this case and the submissions made above, this Court is not inclined to grant bail to the petitioner. Therefore, the bail application of the petitioner is hereby rejected.
