The petitioner is apprehending his arrest in connection with Belaganj P.S.Case No.164 of 2018 , registered for offences punishable under Sections 323, 341, 379, 498(A)/34 of the Indian Penal Code.

Allegation against the petitioner is of ousting his wife with respect to demand of dowry and also accused persons including the petitioner who happens to be husband have assaulted her; due to which she started living in her 'Maike'. Submission of the learned counsel for the petitioner is that she is residing in her 'Maike' and the marriage was solemnized 11 years ago , as such the petitioner has filed a divorce case against the informant.

Patna High Court CR. MISC. No.6646 of 2019(3) dt.02-04-2019 2/2 Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail and further submitted that the informant is still ready to reside with the petitioner, if she is allowed to live with dignity and care.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, surrender before the court below on 18.04.2019 and on that day the O.P.no.2 shall also remain present in the court below, on that the petitioner shall be released on provisional bail in connection with Belaganj P.S.Case No.164 of 2018 for the period of two months, in the meantime, the learned court below will try to reconcile the matter between the parties and on reconciliation if he is satisfied with the conduct of the petitioner, he will confirm the bail bond of the petitioner, otherwise he is free to cancel the bail bond of the petitioner.

With the aforesaid observation, this application is disposed of.
