1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The present application has been filed for modification of the order dated 28.10.2024 passed in Cr. Misc. No. 71820 of 2024 whereby the present petitioner- Indal Paswan @ Sushil Paswan @ Indral Paswan (petitioner no. 3 therein) along with others were directed to appear before the court below within a period of five weeks from the date of order to consider their prayer for bail in accordance with law keeping in view the well established principle that a person who is already on police bail shall not be denied such privilege unless there is any allegation of misuse of the same.
3. Learned counsel for the petitioner submits that due to ill
Patna High Court CR. MISC. No.6733 of 2025(2) dt.07-02-2025 2/2 health the petitioner could not appear before the learned court below within the stipulated time of five weeks. He, accordingly, prays for further two weeks time for the aforesaid purpose.
4. Having regard to the submissions made on behalf of the petitioner, let the time granted by this Court to appear before the learned court below by order dated 28.10.2024 passed in Cr. Misc. No. 71820 of 2024 be extended by further two weeks from today.
5. Accordingly, this application is allowed to the extent indicated above.
