====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-03-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offence punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109, 103, 352, 351(2) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, all the FIR named accused persons including these petitioners came to the house of

Patna High Court CR. MISC. No.8225 of 2025(2) dt.06-03-2025 2/3 the informant and started abusing her and on protest by her father-in-law, the accused persons assaulted him. Co-accused Pappu Yadav indiscriminately assaulted the informant as well as her father-in-law by means of knife. Father-in-law of the informant died on the spot.

4. It is submitted on behalf of the petitioners that specific allegation of assault by knife is against co-accused Pappu Yadav. Petitioners can only be said to be members of unlawful mob and instigating co-accused Pappu Yadav. No overt act has been alleged against these petitioners. Petitioners claim clean antecedent.

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within eight weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bikramganj, Rohtas at Sasaram in Karakat Police Station Case No. 481 of 2024, subject to the conditions laid down under section 482 of the the Bharatiya Nagarik
