JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2019 This is an application for grant of anticipatory bail in connection with Complaint Case No. 141(C) of 2018, disclosing offences under Sections 498(A), 304(B) and 201 of the Indian Penal Code.

Allegation against the petitioner, who happens to be the husband of the deceased, is of committing dowry death of the deceased.

Submission of learned counsel for the petitioner is that case case lodged on the basis of complaint case, which disclosed that the deceased died on 29.04.2017, however the complaint petition was filed on 21.03.2018 almost after one year and as a matter of fact she was under treatment at Varanasi and

No.7203 of 2019(4) dt.04-04-2019 2/2 was residing there and the death certificate has been issued by the Government of Uttar Pradesh, which is Annexures P-4 and P-5 and it has further been submitted that at that time, the complainant and her family members were present and they had not lodged any case and now after such a long time, this case has been filed with ulterior motive.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi, in connection with Complaint Case No. 141(C) of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
