JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-09-2025 The learned counsel for the parties have jointly submitted that the encroacher has filed an appeal bearing Encroachment Appeal Case No.55 of 2023, which is pending considering before the learned District Magistrate, East Champaran at Motihari.

2. In such view of the matter, the learned counsel for the petitioner submits that the District Magistrate, East Champaran at Motihari be directed to dispose off the aforesaid appeal within a stipulated time frame.

3. The learned counsel for the opposite party submits

Patna High Court MJC No.203 of 2023(4) dt.26-09-2025 2/2 that in case the aforesaid appeal is pending consideration before the District Magistrate, East Champaran at Motihari, he shall definitely dispose off the same within a stipulated time frame, as is directed by this Court.

4. Accordingly, while disposing off the present petition, I deem it fit and proper to direct the District Magistrate, East Champaran at Motihari to dispose off the aforesaid appeal within a period of six weeks from today, in case the same has not already stood disposed off.
