JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2020 This is an application for grant of anticipatory bail in connection with Ghanshyampur P. S. Case No. 160 of 2017 disclosing offences under Sections 272 & 273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery of 8-1/2 liters of liquor from the motorcycle and one person was arrested and on whose confession recovery is also from the house of co-accused. Petitioner is named by the co-accused, as the co-passenger.

Submission of the learned counsel for the petitioner is that there is vague allegation that he was also sitting on the motorcycle. There is absolutely nothing against him. Heard learned A.P.P. also.

Having heard both sides, considering the above

Patna High Court CR. MISC. No.4092 of 2020(2) dt.22-01-2020 2/2 submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Darbhanga, in connection with Ghanshyampur P. S. Case No. 160 of 2017.
