The petitioner seeks bail in a case registered under Sections 379, 411, 420 of the Indian Penal Code.
The prosecution case, in brief, is that the man standing behind the informant, changed ATM Card and withdrew an amount of Rs. 17,000/- from informant's wife account. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 20-05-2018. The petitioner has been falsely implicated in the present case. There is no other substantive evidence to suggest the implication of the petitioner in the present case. It is further submitted that the petitioner is
Patna High Court CR. MISC. No.9224 of 2019(3) dt.12-04-2019 2/2 ready to deposit an amount of Rs. 10,000/- in the court below which will be subject to final outcome of the case. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, the petitioner is directed to deposit an amount of Rs. 10,000/- in the court below which will be subject to final outcome of the case. On doing so, the petitioner, above named, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Purnea in connection with Mirganj P.S.
