2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 354, 379, 504, 506 and 34 of the Indian Penal Code.

3. Petitioner is alleged to have abused and assaulted the informant and his son in drunken condition

Patna High Court CR. MISC. No.11317 of 2024(2) dt.22-02-2024 2/3 and also threatened to implicate them in a false case .

4. It is submitted on behalf of the petitioner that he has falsely been implicated in this case due to pending land dispute between the parties, for which Title suit No. 314 of 2022 has been filed by both the parties. There is also a counter PS. Case No. 459 of 2023 has been lodged by the petitioner's side against the informant Durga Devi and her family members. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the clean antecedent of the petitioner and other circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist. Class, Patna in connection with Gardanibag P.S. case No. 557 of 2023 , subject to the conditions laid down under section
