1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2),
Patna High Court CR. MISC. No.8621 of 2025(2) dt.07-03-2025 2/3 115(2), 109, 303(2), 352 and 3(5) of BNS Act.
3. Learned counsel for the petitioners submits that petitioner no.1, 3 and 7 have antecedent of three cases and petitioner no.2, 4, 5, 6, 8, 9 and 10 are persons with clean antecedent and the informant alleges that the accused persons came when informant was getting her house constructed and Ramji and Raju assaulted her by rod causing injury on head, thereafter Daroga and Madan assaulted Achchelal causing injury on head.

Learned counsel for the petitioners submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that on account of dispute relating to construction of house, the occurrence is alleged to have taken place. It is also submitted that the injury suffered by the injured is simple in nature as would manifest from Annexure-2 series to the instant anticipatory bail application which amply demonstrates that petitioners never had any intention of committing a serious occurrence. It is next submitted that from side of the petitioners also Majhaulia P.S. Case No.442/2024 was instituted.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
6. Considering the submissions made by the learned
Patna High Court CR. MISC. No.8621 of 2025(2) dt.07-03-2025 3/3 counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in connection with Majhaulia P.S. Case No.441/2024, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
