The petitioner is in custody in a case registered for the offence punishable under Sections 363 and 366A/34 of the Indian Penal Code and Section 8 of the POCSO Act. As per allegation in the FIR, it is a case of kidnapping of the minor daughter of the informant and theft of cash of amount of Rs. 3,00,000/- and jewelry worth Rs.60,000/- of the informant by the petitioner and other co-accused persons.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. He next submits that earlier the prayer for bail of this

No. 85699 of 2023 with an observation that the "the trial Court is directed to conclude the trial preferably within a period of six months from the date of receipt of a copy of this order and if the trial is not concluded, the petitioner may renew his prayer for bail" but the trial trial is not concluded till today. Petitioner is in custody since 31.08.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

On perusal of the first information report, impugned order dated 13.09.2023 and perusal of the stage of the trial vide letter no.99 dated 19.02.2025, submitted by the trial court that the trial of this case is likely to be concluded within two months and also submits that four prosecution witnesses have been examined. Accordingly, the learned trial Court is directed to conclude the trial within two months as stated vide letter no.99 dated 19.02.2025.

7. The petitioner is directed to cooperate in the trial and if the trial is not concluded with cooperation of the petitioner, the petitioner may renew his prayer for bail before the trial court and the trial court shall grant him bail to the petitioner, so I am not inclined to grant bail to the petitioner.

8. Prayer for regular bail of the petitioner is again rejected.
