2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

3. As per prosecution case, 5 liters of country made liquor was recovered from the hut situated at Mahadiya Dam.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Recovery has been made from an open place, accessible to one and all. Petitioner claims

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court No.-1, Muzaffarpur in connection with Minapur P. S. Case No. 436 of 2021, subject to condition as laid down under Section 482 of B.N.S.S.
