The petitioner is apprehending his arrest in connection with Complaint Case No.C1/1537 of 2016 dated 16.3.2016 arising out of Bathnaha P.S.Case no.13 of 2016, , registered for offences punishable under Section 365 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping of the minor daughter of the informant.
Submission of the learned counsel for the petitioner is that the police after investigation has not found the case true, however, on protest the cognizance has been taken and the other
Patna High Court CR. MISC. No.2141 of 2019(3) dt.13-03-2019 2/2 co-accused persons have been granted privilege of anticipatory bail, vide order dated 6.4.2018 passed in Cr. Misc. No.19603 of 2018.
Heard learned A.P.P. also.
Having heard both sides and in view of the fact and circumstances, as stated above, the provisional bail granted to the petitioner, vide order dated 16.01.2019 passed in Cr. Misc. No.2141 of 2019 is affirmed.
With the aforesaid observation, this application is allowed.
