Patna High Court CWJC No.9008 of 2017 dt.12-07-2017 2/3 Khuskibagh, Purnia, has approached this Court, through its In-Charge Principal, seeking direction to the respondents to consider the grievance of the institution for its recognition and registration of its students with Bhupendra Narayan Mandal University, Mahepura (hereinafter referred to as the "University"), in Part-I of Bachelor Degree, in different faculties for the academic session 2015-16 and allow the students to submit their fees and forms for the ensuing Examination, 2017.
2. This is an admitted fact that the college, in question, is not affiliated to the University. Therefore, there is no question of this Court issuing a direction to the respondents-University to register the students of the said college and accept their examination forms etc. The Court fails to understand as to how the college has taken admissions in various courses, in the absence of any affiliation granted by the University.
3. Learned counsel, appearing on behalf of the petitioner, has submitted that the main grievance of the petitioner is that the University and the State-respondents are not considering the application made by the college for grant of recognition/registration, which is pending. He has further submitted that inspection of the college has already been done by an Inspection Team of the University.

4. Considering the facts and circumstances of the case, this application is disposed of with an observation that the University and the State authorities are bound by the statutory provisions to consider the application filed on behalf of the University for grant of affiliation/recognition.
5. Learned counsel, appearing on behalf of the petitioner, has submitted that Inspection Report is already available with the University on which decision for grant of approval could be taken.
6. If that be so, let the University take a final decision in this regard within a period of two months from the date of receipt/production of a copy of this order.
