JUSTICE PRABHAT KUMAR JHA ORAL ORDER 14-08-2015 Heard the learned counsel for the petitioners, the learned Additional Public Prosecutor and Sri Vivekanand Singh, the learned counsel for the informant.
The petitioners seek bail in a case under Section 302 and other sections of the Indian Penal Code.
The petitioners and other accused persons are alleged to have assaulted Maheshwar Yadav and his family members indiscriminately with stick.
It is submitted that Maheshwar Yadav got one injury on his head but who assaulted Maheshwar Yadav is not specified in the FIR. Other three injured persons got simple injuries. Similarly situated accused Pashok Yadav @ Pashupati Yadav and
Patna High Court Cr.Misc. No.30787 of 2015 (2) dt.14-08-2015 2/2 Ghultan Yadav have already enlarged on bail and the case of the petitioners stands on same footing.
The learned counsel for the informant, however, opposed the prayer for bail but could not be able to distinguish the case of the petitioners from the case of other two accused persons who have already been enlarged on bail.
Considering the facts aforesaid and the nature of allegation made against the petitioners, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions judge, Khagaria in Alauli P.S. Case No. 230/14 (G. R. No. 2020/14) corresponding to S. Tr. No. 89/15.
