Petitioner being husband of the deceased is languishing in jail custody since 30.5.2014 in a case registered under section 304B of the Indian Penal Code.

Marriage of the deceased had taken place 5 to 6 years ago and after marriage, she gave birth to a child. Although it is stated by the informant that the deceased was beaten up by the petitioner with fists and slaps on the alleged date of occurrence but the post mortem report of the deceased does not support the aforesaid allegation as no external injury was found on the person of the deceased and the doctor could not succeed to give his definite opinion regarding cause of death of the deceased. No doubt, in course of investigation, witnesses supported the story of assault and the Investigating officer noticed that blood was oozing out from the mouth of the deceased at the time of

No.819 of 2015 (4) dt.01-07-2015 preparation of inquest report but considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in Raniganj P.S. Case no. 86/2014.
