JUSTICE JYOTI SARAN) 24-06-2019 Heard Mr. Jitendra Prasad Singh, learned counsel for the petitioner and Mr. Avinash Kumar for the Nagar parishad, Dehri, Mr. Shiv Kumar, A.C. to G.A.3 for the State and Mr. Punit Siddharth who appears for the intervenors seeking to intervene in the present proceedings to oppose the writ petition in I.A. No. 01 of 2019.

The petitioner complained that the level of the road is unnecessarily being increased for laying down of the drainage pipes. It is on notice that the Nagar Parishad has appeared

Patna High Court CWJC No.1866 of 2019(5) dt.24-06-2019 2/2 through counsel and by filing counter affidavit it is informed that it is to overcome water logging as well as to meet the height of the main road that the level have been increased. At paragraph 14 of the counter affidavit it is also mentioned that no inconvenience would be caused to the house owners of the locality including the petitioner who has also taken part in the construction and got two pipes fixed from his house for facilitating the drainage from his house.

In such view of the matter, no further indulgence is required in the matter as the action taken is in the best interest of the residents of the locality.
