The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. The petitioner is not named in the FIR. The police arrested the petitioner and the petitioner is said to have confessed his guilt. From the possession of the petitioner a Kil was recovered which is used for getting the tyre punctured. It is submitted that the petitioner was not put on test identification parade nor the petitioner confessed his guilt. The petitioner was forced to put his signature on the so-called confessional statement.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of
Patna High Court Cr.Misc. No.30709 of 2015 (2) dt.14-08-2015 2/2 Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas at Sasaram in Kargahar P.S. Case No. 71 of 2015. (Prabhat Kumar Jha, J.) KKSINHA/- U T
