JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 31-07-2019 Supplementary affidavit filed today on behalf of the State is taken on record.
It has been stated by the learned counsel for the applicant that the directions have been complied with. Learned counsel for the State-respondent also has accepted this position.
However, an intervention application has been filed by one Anjani Kumar Sinha whose contention is that the exercise of eviction which has been carried out under the garb of compliance of the directions of this Court, has virtually affected the rights of the applicant and, therefore, the same could not have been done without adjudicating upon the claim of the applicant.
Litigation has ensued in this regard and, therefore, we consign this contempt proceeding without prejudice to the rights of the intervenor to pursue and seek his remedy before the
Patna High Court MJC No.5215 of 2018(5) dt.31-07-2019 3/3 appropriate forum in accordance with law and the disposal of this contempt application or the orders passed herein will not be an impediment in pursuing the remedies in order to seek any appropriate relief.
