The petitioners are apprehending their arrest in connection with Daraunda (M.H. Nagar) P.S.Case no.92 of 2018 , registered for offences punishable under Sections 147, 302 and 427 of the Indian Penal Code.

Prosecution story as per the statement made by the informant who is cousin brother of the deceased is that his cousin brother had gone to market and an altercation was going on between two parties and at the instance of the coaccused , the petitioner and other accused persons assaulted him by lathi and danda and when he tried to flee away from there he lost his balance and fell down and thereafter again he was assaulted. The petitioner is also named in the FIR. Submission of the learned counsel for the petitioners is

No.9470 of 2019(4) dt.09-05-2019 2/2 that though he is named in the FIR and the informant is the eye witness of the occurrence and the other witnesses who have been examined during the investigation have not disclosed the name of the petitioners and this has also been mentioned in the impugned order.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, surrender before the court below within a period of six weeks from the date of receipt of order and on surrender they will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM XI, Siwan in connection with Daraunda (M.H. Nagar) P.S.Case No.92 of 2018 -, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

With the aforesaid direction, this application is allowed.
