The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 365, 366(A), 120(B), 376 of the Indian Penal Code and Section 4/8 of the POCSO Act. It is submitted that petitioner along with Akhilesh Chauhan and Dhirendra Yadav has kidnapped the victim by motorcycle. The victim has made her statement under Section 164 Cr.P.C. in which she has alleged the commission of rape against Akhilesh Chouhan. The petitioner is in custody since 18.10.2014 having no criminal antecedent. Similarly situated co-accused Dhirendra Yadav has been granted bail by Cri. Misc. No. 17251 of 2015 (Annexure-4).

No.32502 of 2015 (2) dt.17-08-2015 2/2 Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Aurangabad in Nabinagar P.S. Case No 138 of 2014 with the following conditions :

1.

One of the bailors will be the close relative of the petitioner.

2.

The petitioner will not indulge in similar or in any other offence.

3.

The petitioner will be well represented in the court.

4.

In case of absence for two consecutive dates or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
