The petitioner seeks bail in Barachatti (Mohanpur) P.S. Case No. 708 of 2021, registered for the offence punishable under Sections 366(A) of the Indian Penal Code. As per prosecution case, petitioner with the help of co-accused persons kidnapped the daughter of informant with intent to marry her.

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The victim girl in her statement under Section 164 Cr.P.C has not stated any foul against this petitioner rather she only stated that petitioner was co-villager and he only dropped her at Damuara market on his motorcycle. Petitioner is in custody since 16.11.2021 having clean antecedent.

No.6520 of 2022(3) dt.19-05-2022 2/2 In view of statement of victim girl under Section 164 Cr.P.C, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 708 of 2021.
