JUSTICE ASHUTOSH KUMAR ORAL ORDER 06-01-2022 Heard Mr. Alok Kumar Alok, learned counsel for the petitioner and learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Kazimohammadpur P. S. Case No. 76 of 2020, instituted for the offences under Section 366A of the Indian Penal Code.
The petitioner is alleged to have abducted the minor daughter of the informant. In the statement given under Section 164 Cr.P.C., the victim girl has disclosed other facts. For the fear of being lampooned by other students of the coaching class, the victim went to
Patna High Court CR. MISC. No.16495 of 2021(2) dt.06-01-2022 2/3 Gorakhpur and from there to Delhi. From Gorakhpur to Delhi, she has accompanied by the petitioner. Later, she came back home.
There is no accusation against the petitioner of having subjected her to any sexual misdemeanor. The statement given by the victim girl under Section 164 Cr.P.C. further reveals that she, of her own volition, had accompanied the petitioner and had stayed at Gorakhpur and Delhi Railway Stations.
Regard being had to the afore-stated facts, the petitioner, above-named, in the event of his arrest or surrender before the court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -I (East), Muzaffarpur, in connection with Kazimohammadpur P. S. Case No. 76 of 2020, subject to the conditions laid down under Section 438(2) of the
Patna High Court CR. MISC. No.16495 of 2021(2) dt.06-01-2022 3/3 Cr.P.C.
This petition stands allowed.
