JUSTICE SUDHIR SINGH ORAL ORDER 05-08-2015 The petitioner is languishing in custody since 14.01.2015 in connection with Sarsi P.S. Case No. 13 of 2015 for the offences instituted under Sections 341, 323, 363, 366A, 370, 372 and 504 of the I.P.C.

Heard learned counsel for the petitioner and learned counsel for the State.

The accusation is of kidnapping the minor daughter of the informant by the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.01.2015 and the charge sheet has been submitted in the present case. It is further submitted that the petitioner is made accused in the present case due to mistake of fact. Other co-accused has been granted bail vide Cr. Misc. No.

Patna High Court Cr.Misc. No.29338 of 2015 (2) dt.05-08-2015 2/2 9961 of 2015.

On behalf of the State it has been submitted that the victim has named this petitioner in 164 Cr. P.C. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, Purnea, in connection with Special Case No. 02 of 2015, arising out of Sarsi P.S. Case No. 13/2015.
