The petitioner is languishing in jail custody since 12.01.2015 in a case registered for offences punishable under Section 394 of the Indian Penal Code.
The prosecution case as per written report of the informant is that on 18/19.06.2014 at 11.30 P.M. when the informant reached near Mangal Akhara by the side of Patna City Railway Station some miscreants surrounded him and on the point of pistol and knife snatched his belongings and mobiles. Learned counsel for the petitioner submits that the petitioner has not been named in the F.I. R. and his name figured during investigation on the confessional statement of one of the
Patna High Court Cr.Misc. No.29222 of 2015 (2) dt.05-08-2015 2/2 co-accused Vikash Kumar @ Mallu.
It has further been submitted that the petitioner has no criminal antecedent and has not been put to Test Identification Parade and a Co-ordinate Bench of this Court has granted privilege of bail to one of the co-accused Manish Kumar vide Cr. Misc. No. 15009/2005 dated 07.05.2015.
Since the petitioner has been made accused for the same and similar allegations, I see no reason to take a different view. Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st class in Patnacity in Malsalami P.S.Case No. 182/2014.
