The petitioner has preferred this application for grant of regular bail in a case registered under sections 498A, 307, 341, 323, 504, 506 and 379 of the Indian Penal Code and sections 3 and 4 of the Dowry Prohibition Act. As per the prosecution case, the informant was married to the petitioner herein in the year 2016. It is alleged by the informant that she was tortured for non-fulfillment of demand of dowry to the tune of Rs. 2 lacs.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and

Patna High Court CR. MISC. No.15852 of 2021(3) dt.14-09-2021 2/2 concocted. There is no material nor any details to substantiate the allegations. The petitioner disputes the very factum of marriage to the informant-opposite party no.2 herein. Investigation in the case has concluded with submission of charge sheet. The petitioner is in custody since 30.8.2020 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner having remained in custody for over 1 year together with charge sheet having been submitted in the case and the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Pandarak P.S. Case no. 86 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barh, Patna.
