The petitioner is languishing in custody since 23.03.2014 in a case registered for the offences punishable under Sections 376, 120B and 201 of the Indian Penal Code. It is alleged by the informant through a written report that the petitioner established forceful physical relationship with her.
It is submitted by learned counsel for the petitioner that the informant happens to be the petitioner's sisterin-law (Bhabhi) and in 164 Cr.P.C. statement as contained in Annexure-2 she has stated that due to the fight between the petitioner and her, she lodged the present case but actually no rape
Patna High Court Cr.Misc. No.31357 of 2014 (05) dt.02-02-2015 2/2 was committed. The medical report also does not suggest commission of rape.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Purnea in connection with Dhamdaha P.S.
