The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.
As per the prosecution case, the six named accused persons including the petitioner herein are stated to have fired indiscriminately injuring the cousin (chachera) brother of the informant namely Prince Kumar.
It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The allegations are not supported from the injury report wherein no gunshot injury has been found. The petitioner is in custody since 9.11.2020 and charge sheet has been submitted in the case.

No.15819 of 2021(3) dt.09-09-2021 2/2 The application for bail is opposed by learned APP for the State and learned counsel for the informant who submits that not only the petitioner is named in the FIR but there is direct allegation against him along with others of having fired hitting the cousin brother of the informant namely Prince Kumar. The said allegation has been supported by the injured witness Prince Kumar in course of investigation as also by the injury report wherein the injury has been found to be grievous.
Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the submissions made on behalf of the petitioner, the contents of the injury report and the petitioner having remained in custody for over nine months, the Court directs the petitioner to be enlarged on bail in connection with Didarganj P.S. Case no. 171 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IV, Patna City, Patna.
