The petitioner is in custody in a case registered under Sections 364 and 302 of the Indian Penal Code. It is alleged by the informant that on 11.01.2012 at about 7.30 P.M. he got information from his son that his grand son, namely, Rahul Kumar, aged about 7 years was kidnapped by unknown culprits. On 12.1.2012, in the morning, he found the dead body of his grandson.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 14.05.2015.There is no allegation of tampering with the evidence against the petitioner. In course of investigation only

Patna High Court Cr.Misc. No.29599 of 2015 (3) dt.16-10-2015 2/2 suspicion is raised against the petitioner . There is no circumstantial evidence to suggest the implication of the petitioner in the present case. It is further submitted that the petitioner may be released, after completion of six months in custody from 14.5.2015.

On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the facts aforesaid, let above named petitioner be released, after completion of six months in custody from 14.05.2015, on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M.,Birpur (Supaul) in Nirmali P.S.Case No. 04 of 2012.
