This is the second attempt for grant of bail. Earlier, prayer for bail of petitioner was rejected by order dated 01-12-2015 passed in Cr. Misc. No. 52094 of 2015. While rejecting the bail petition, liberty was granted to the petitioner to renew prayer for bail after completion of ten months in custody. In paragraph - 12 of the petition, a specific stand has been taken that petitioner has already completed ten months and he is in custody since 11-07-2015.

In view of observation recorded earlier in Cr. Misc. No. 52094 of 2015, since petitioner has already completed ten months in custody, there is no reason to further detain the

Patna High Court Cr.Misc. No.21641 of 2016 (2) dt.18-05-2016 2/2 petitioner.

Let the petitioner namely Anshu Rai be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Harsh Vardhan, learned Judicial Magistrate 1st Class, Gopalganj/concerned court in connection with Gopalpur P.S. Case No. 53 of 2015.
