Learned counsel appearing on behalf of the petitioner submits that the petitioner has retired from service prior to 01. 01.2016 and he has filed the present writ application for the benefit of revised pension and payment of other admissible dues in terms of Resolution of Government bearing Resolution No. 755 dated 20.10.2017.

Considering the fact that the petitioner has retired from service and the Resolution of the State Government is applicable for fixation of pension, the writ petition is disposed of with a direction to the respondents to take final decision with

Patna High Court CWJC No.3863 of 2020(2) dt.23-06-2020 2/2 regard to entitlement of the petitioner for payment of retiral dues and pensionary benefits in terms of Resolution of the State Government and ensure payment thereof within a maximum period of three months from the date of receipt/production of a copy of this order, failing which the petitioner shall be entitled to payment of interest @ 9 % from the date of retirement till the date of actual payment.

With the aforesaid, the writ application stands disposed of.
