The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, the petitioner armed with farsa as also other accused persons are stated to have assaulted Ravindra Yadav leading to his death.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations levelled against the petitioner in the FIR are not supported from the contents of the postmortem report wherein the cause of death is stated to be as a result of haemorrhage and shock due to injuries caused by hard and blunt force object. Patna High Court CR. MISC. No.15844 of 2021(3) dt.14-09-2021 2/2 submitted that the case of the petitioner stands on a similar footing to that of co-accused who has been enlarged on bail. The petitioner is in custody since 21.9.2020 and has no criminal antecedent. Charge sheet has been submitted in the case. The application for bail is opposed by learned APP for the State who submits that there is direct allegation against the petitioner of having assaulted Ravindra Yadav leading to his death.

Having heard learned counsel for the parties and taking into consideration the allegation against the petitioner in the FIR leading to the death of Ravindra Yadav, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
