JUSTICE SANJAY PRIYA ORAL ORDER 04-02-2019 Heard the learned counsel for the petitioners, the informant and the learned A.P.P. for the State. The petitioners seek bail in Jagdishpur P.S. Case No. 109/2018, instituted for offences under Section(s) 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

It is alleged in the written report that these petitioners executed sale deed in respect of the land of informant in favour of other accused persons, as mentioned in the sale deed, under conspiracy by showing the informant to be dead. Learned counsel for the petitioners has submitted that prior to filing of instant case, informant has already filed Title Suit No. 09 of 2018 challenging the aforesaid sale deed. It is further submitted that civil remedy is available to the informant

Patna High Court Cr.Misc. No.6064 of 2019(2) dt.04-02-2019 2/2 for the aforesaid allegation as alleged in the written report. Learned counsel for informant has opposed the prayer for bail of petitioners.

Petitioners are in custody since 26.07.2018. Considering the aforesaid facts and circumstances, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 109/2018, subject to the conditions that both the bailors shall be the close relative of the petitioners. (Sanjay Priya, J) rakhi/- U T
